Using Trademarked Keyterms in Your Paid Search Ads?

You’ve probably asked yourself if using trademarked terms is a legit strategy - if not a legal one. A recent decision by the U.S. District Court of Eastern PA has held that it is in fact legal to use trademarked terms when bidding in paid search advertising. However, you must not use the names in the actual titles and ad text that the customer will see.
This answers one question, but asks a few more. What about the context of more generic terms that happen to be trademarked in another industry? This is one step is clarifying the issue, but it is simply that - a step.

Now, when I heard recently about MarketingExperiments.com joining forces with Marketing Sherpa and Anne Holland, I recognized a great partnership and educational force for e-merchants. Sherpa publishes great reports and does very strong workshops and the MarketingExperiments.com provides free webinar briefings and excellent applied research. IMHO, these two great leaders and their teams are among the most influential in ecommerce. Merchants would do well to pay attention to their thoughts.
- And third, For those of you not familiar with the YstoreBlog, it is Yahoo! Merchant Solutions official blog for Yahoo! Store Owners. The Yahoo! Store Blog has great ‘best practices’ for Yahoo! Merchants and beyond and a few coding tips for those do-it-yourselfers out there.

After nearly a decade of serving thousands of web stores across the country, as of Feburary 1, 2007, Ydesigns.com is rebranding itself as Fast Pivot. As we have expanded beyond custom store design into web marketing strategy and ecommerce software development and integration, we have found the Ydesigns brand too limiting to contain our larger scope. So, in short, we have not been acquired. We are the same people team, under the same ownership, expanding to serve a larger audience more effectively.
